Clarification of State Legislation vs National Recognition of White Cards.February 2010
Recently the QLD government (Licensing Department, Workplace Health and Safety QLD, Department of Justice and Attorney General) have provided clarification regarding interpretation of the legislation surrounding mutual recognition of White Cards across Australia and the ability of RTO’s to offer White Card courses in different States of Australia.
Essentially, even though there is mutual recognition of the White Card between states for holders of the Card who relocate between states, for residents of each respective State the State government legislation is set up to generally ensure that the resident completes the White Card course with an RTO within that State, whether they be face-to-face or online.
Thus, the Queensland legislation and licensing instruments predicate that a Queensland based RTO can only issue a White Card to competent participants who are resident in Queensland, or maybe be requiring a QLD White Card (in which case they are required to sit the assessment in Queensland).
